AGB – Personalvermittlung

1. Scope These General Terms and Conditions apply to all services provided by B&G Projects GmbH in the field of personnel placement to its clients. Differing terms of the client apply only if expressly agreed in writing.

2. Subject of the contract The recruitment agency assists the client in finding and selecting suitable candidates for open positions, including providing candidate profiles and arranging interviews. There is no guarantee of successful placement.

3. Placement fee If an employment contract or other paid collaboration is concluded between client and an introduced candidate as a result of the agency's activities, a claim arises for the agreed placement commission, due upon conclusion of the contract.

4. Protection against circumvention If an employment relationship or other paid cooperation is established within 12 months of the introduction of a candidate, this is considered a successful placement, and the commission is payable regardless of whether the contract is concluded directly or via third parties.

5. Sharing of candidate profiles Candidate profiles and information provided are intended solely for the client and may not be passed to third parties without prior consent.

6. Duty to provide information The client must inform the agency immediately as soon as a presented candidate makes direct contact or applies independently.

7. Liability The agency assumes no responsibility for the accuracy of candidate information or the future professional success of a placed candidate.

8. Confidentiality All exchanged information must be treated confidentially.

9. Data protection Personal data is processed exclusively in accordance with applicable data protection regulations.

10. Final provisions The laws of the Federal Republic of Germany apply. Place of jurisdiction, where legally permissible, is the registered office of the service provider.
