AGB – Arbeitnehmerüberlassung (Zeitarbeit)

1. Scope These General Terms apply to all contracts for the temporary placement of employees between B&G Projects GmbH and the respective hirer.
2. Temporary employment The agency provides employees to the client company. Deployment is based on the German Temporary Employment Act (AÜG).
3. Right to issue instructions During the assignment, the seconded employee is subject to the professional instructions of the hirer.
4. Working conditions The hirer complies with applicable occupational health and safety regulations and instructs the seconded employee accordingly.
5. Remuneration The hirer pays the agreed remuneration per the temporary employment contract concluded between the parties.
6. Transfer of employees If the hirer intends to take a temporary employee into direct employment, the agency must be informed in advance. On takeover during the assignment or within 6 months after its termination, a takeover commission may be payable per the contractual agreements.
7. Liability The agency is liable only for damages resulting from intentional or grossly negligent conduct.
8. Confidentiality All exchanged information must be treated confidentially.
9. Data protection Personal data is processed in compliance with applicable data protection laws.
10. Final provisions The laws of the Federal Republic of Germany apply. Place of jurisdiction, where legally permissible, is the registered office of the service provider.
